Following a November 2011 leak of about 3,600 barrels of oil from a rig offshore of Brazil, Chevron Corp. (NYSE: CVX) and driller Transocean Ltd. (NYSE: RIG) were slapped with a penalty of $17.5 billion by the governments public prosecutors office. That payment reportedly hasbeen reduced to less than $42 million as the company and the government have agreed on a settlement.

Because REITs and MLPs retain limited earnings, they're forced to tap capital markets pretty often. That can be good, because it forces discipline, but cyclical, capital-intensive, and/or debt-laden companies aren't particularly suited for the structure. Transocean (NYSE: RIG  ) as an MLP, Carl Icahn? No, thank you. A deepwater driller, subject to the drilling cycle's wax and wane, capital intensivity, and relatively continuous reinvestment needs doesn't fit the mold.

Top 10 Small Cap Companies To Invest In 2014

Gregory James Van Raalte/Shutterstock The mumbo-jumbo used in the stock market can stop many potential investors in their tracks. So is deciphering the lingo so you make smarter investment decisions. Today, we'll start with three basic terms that define the investment strategy of many mutual funds: large cap, mid cap and small cap. "Cap" is short for capitalization and basically describes the size of the company in terms of its stock market value. Market cap is determined by multiplying the number of shares of stock a company has issued by the stock price. That means a company's market cap can fluctuate, but those daily moves don't usually change its place in these three categories. A Capital Idea Apple (AAPL), Exxon Mobil (XOM) and General Electric (GE) are three of the biggest companies in the world. Apple, the world's largest company, has a market cap of approximately $570 billion. Such giant companies make up the large cap sector. Large caps generally have a market value of more than $10 billion -- maybe $15 billion, by some definitions. That means they tend to be well-established companies with strong financial profiles, and many pay regular dividends.

The mid-cap sector is an often-unloved group in the investment world.

www.youtube.com There were plenty of winners and losers this week on Wall Street, with a restaurant chain embracing more natural ingredients and an old website digging into your past to woo you back. Here's a rundown of the week's smartest moves and biggest blunders. YouTube -- Winner It's been two summers since Psy uploaded the official "Gangnam Style" video to Google's (GOOG) YouTube. It blew up as a global single later in the year. This week, it surpassed 2 billion views on YouTube. It's a notable achievement for the South Korean pop music star, but it's also a big deal for YouTube. After all, the milestone shows how popular YouTube is as a video-sharing platform. Most folks may have tired of the video and the song ages ago, but clips live on forever in cyberspace. YouTube just validated itself again. MySpace -- Loser Speaking of bringing pop stars to life, MySpace -- yes, MySpace -- turned heads this week by sending out old photos posted years ago to the emails of folks with dormant accounts. MySpace had its moment in the sun before giving way to Facebook (FB), but the social networking dinosaur now jointly owned by Specific Media and pop icon Justin Timberlake, is struggling to regain its relevance. Sending old pics to folks that have moved on may seem like a clever tactic given the popularity of Throwback Thursday, but it comes off desperate at best, and creepy at worst. Panera Bread (PNRA) -- Winner Panera became the latest eatery to climb onto the organic food bandwagon this week. The chain of bakery cafes revised its food policy, moving to do rid its menu of artificial colors, flavors and preservatives by 2016. It's a smart move for Panera. Growth at the former quick-service darling has been slowing lately, with analysts targeting top- and bottom-line growth in the mid-single digits. Anything it can do to beef up its profile with the growing number of consumers angling for natural foods will only help. Walmart (WMT) -- Loser The world's larg

The graph shows how the market changed from 2008 through 2012, favoring the Iaas (infrastructure as a service) hosting business model (Amazon (AMZN) and Rackspace (RAX)), while leaving the server-side infrastructure business model in great trouble. At this point, the trend towards adoption of hosted Iaas as a replacement for traditional in-house server-side infrastructure can't possibly be reversed.

Alamy You can never know in advance all the news that will move the market in a given week, but some things you can see coming. From the release of a new video game console to an earnings report out of the world's largest retailer, here are some of the items that will help shape the week that lies ahead on Wall Street. Monday -- Host in the Machine: Most Internet users take web-hosting for granted, but leading websites and apps wouldn't be available if it wasn't for the growing fleet of servers manned by companies specializing in getting websites up and running. Rackspace (RAX) is a market darling among web hosts, and on Monday it will serve up its latest financials. This has become a competitive market as providers aim to host websites and cloud computing solutions. The end result is that analysts see Rackspace growing its revenue by a hearty 15 percent, but they also see profitability declining during the quarter. Tuesday -- KFC in China: Yum! Brands (YUM) is the parent company behind the fast food team of Pizza Hut, Taco Bell, and KFC. A surprisingly large portion of Yum! Brands' business in recent years has come from expanding its chicken chain in China. But the market has been challenging lately. Same-store sales for Chinese KFC locations plunged 14 percent in its latest quarter. As a result of its poor performance in the world's most populous nation, Yum! Brands is temporarily offering monthly same-store sales updates. It will offer an update on how October went on Tuesday after the market close. Wednesday -- Panic at the Cisco: It may seem like a long time ago, but there was a brief moment in time -- just before the dot-com bubble popped -- that Cisco (CSCO) commanded the largest market capitalization in the country. The Internet was all the rage with investors, and Cisco was the leading provider of routers, switches, and other networking gear that kept the whole web connected. The past few years have been volatile for Cisco, with the tech bellwet

Top 5 European Stocks To Invest In Right Now

Phil Nijhuis/APA closed desk of Malaysian airlines is seen at Schiphol airport in Amsterdam on Thursday. KUALA LUMPUR, Malaysia -- Malaysia Airlines says that in the wake of the shooting down of one of its passenger jets over Ukraine, it has changed the route its planes will take on flights to and from Europe. The airline said in a statement Friday on its website that all of its European flights "will be taking alternative routes avoiding the usual route." The plane, which was flying from Amsterdam to Kuala Lumpur, Malaysia, crashed Thursday with 298 people on board Flight 17. American intelligence authorities believe a surface-to-air missile brought the aircraft down but it wasn't yet clear who fired it. "The usual flight route was earlier declared safe by the International Civil Aviation Organization. International Air Transportation Association has stated that the airspace the aircraft was traversing was not subject to restrictions," the airline said in a statement on its website. Even though there were no restrictions, Malaysia Airlines may still face questions about why it continued with flight paths over eastern Ukraine -- at the heart of a violent rebellion against Kiev -- when some airlines decided months ago to change routes to skip around the area. In Seoul, Asiana spokeswoman Lee Hyomin said Asiana had a once-a-week cargo flight that had flown over Ukraine but rerouted the flight in early March amid the worsening situation over the Crimean peninsula. Korean Air Line also said it had rerouted cargo and passenger flights in early March amid the worsening situation over the Crimean peninsula. A company official, who requested anonymity in line with department rules, said Korean Air Line had had 42 flights -- 26 cargo and 16 passenger flights -- which flew over Ukraine before. Likewise, Australia's Qantas stopped flying over Ukraine several months ago and shifted its London-Dubai route 400 miles south. A spokeswoman declined to explain the change. The China Civil Aviation Administration said it instructed all domestic airlines to avoid flying over Ukraine. At present, there are a total of 28 round-trip Chinese flights a week that fly over the area. A statement from Hong Kong's Civil Aviation Department said local "airlines do not use air routes that cross Ukrainian airspace."

Advisors' Opinion:

How much impact there will be on the profit margin will depend on the royalty rate set. Virnetx has an established royalty rate structure both published and through agreements with other licensees. Virnetx's published royalty rate is between 1 and 2 percent for customers in good standing. This royalty rate has been validated through licenses with 4 different companies, Siemens (SI), NEC, Mitel (MITL), and Aastra (AATSF.PK). The average rate agreed to by these companies through negotiations is 1.52%, right in the middle of the 1 to 2 percent published rate. Whatever rate is set will further reduce Apple's profit margin.

The Companys flagship product, branded as the Wideboy family of printers, offers packaging designed to fit any office or professional space.

Advisors' Opinion:
  • [By James E. Brumley]

In retrospect, their pullbacks come as no real surprise. Neither Voxeljet AG (NYSE:VJET) nor Camtek LTD. (NASDAQ:CAMT) saw their shares soar on any news that was meaningfully sustainable, and after the "shoot first, ask questions later" market had a chance to start asking questions, it became clear that - even with the largest of glimmers of corporate progress unveiled a few weeks ago - CAMT and VJET both had been bid up more on hype and less on substance. Meanwhile (and this could be bitterly ironic to some), a small cap play in the same 3D printing space that (1) didn't beat the daylights out of its hype-drum, and (2) is actually much closer to bringing a revenue-bearing product to the market [per today's news - more on that below] isn't getting anywhere near the same attention. That company? Makism 3D Corp. (OTCBB:MDDD). The good news is, MDDD finally looks like it's revving its engine, while Camtek and Voxeljet AG shares continue to deteriorate.

Best Blue Chip Stocks To Buy For 2014

There's an old stock market adage: "Sell in May and go away, don't come back till Labor Day." Personally, I don't believe in timing the market, especially on the merits of an anonymous maxim, but today's sell-off certainly didn't do much to disprove the saying. That said, there was some actual news today -- global manufacturing is starting to cool down, U.S. companies are hiring more slowly than anticipated -- that substantiated the drop. Paul Morris/Bloomberg/Getty Images There were plenty of winners and losers this week, with a fast food chain's attempt to offer healthier fare falling short and the world's largest networking equipment company letting pink slips fly. Here's a rundown of the week's smartest moves and biggest blunders. Satisfries -- Loser Burger King Worldwide (BKW) is giving up on trying to woo calorie counters. The burger chain is discontinuing Satisfies -- the crinkle-cut fries that contain 40 percent less fat and 30 percent fewer calories than McDonald's (MCD) signature spud sticks -- at most restaurants. Some franchisees will keep offering Satisfries, but the item didn't stick on its menu for much more than a year. Burger King claims that the item didn't sell well despite clearing roughly 100 million orders for the slightly less unhealthy fries. One can argue that Satisfries were doomed because of Burger King chose to charge more for an order than its traditional fries. Fast food joints are magnetic to folks looking to save money. Plus Burger King isn't a big draw to folks on a diet despite following rivals into salads. Monster Beverage (MNST) -- Winner Coca-Cola (KO) has struggled to make a dent in the energy drink market dominated by Red Bull and Monster, so it's betting on a winner. Coca-Cola is investing $2.15 billion to buy a 16.7 percent stake in Monster Beverage. It's a smart move for Coca-Cola as it continues to diversify from carbonated drinks that have fallen out of favor with consumers. However, it's a bigger deal for Monster Beverage. The stock jumped on the news, and rightfully so. Green Mountain Coffee Roasters (GMCR) has soared since Coca-Cola made a similar investment earlier this year. Cisco (CSCO) -- Loser It's another round of pink slips at Cisco. The networking gear giant announced that it that it will be dismissing 6,000 workers or 8 percent of its staff. It's a big number, but the market shouldn't be surprised. This is the fourth summer in a row

Yellen: Job Market Keeps Fed Hesitant on Interest Rate Hike

Hot Sliver Stocks To Invest In Right Now

Jackson Hole-Annual Conference John Locher/APFederal Reserve Chair Janet Yellen JACKSON HOLE, Wyoming -- If anyone thought Janet Yellen might clarify her view of the U.S. job market in her speech here Friday, the Federal Reserve chair had a message: The picture is still hazy. Though the unemployment rate has steadily dropped, Yellen suggested that other gauges of the job market have become harder to assess and may reflect persistent weakness. These include many people jobless for more than six months, millions working part time who want full-time jobs and weak pay growth. Yellen offered no clarity on the timing of the first interest rate increase, which most economists still expect by mid-2015. Investors had been anticipating any firmer sign from Yellen about whether an improving economy might prompt the Fed to act sooner than expected to start raising rates. She instead offered further uncertainty. Damage inflicted by the Great Recession had complicated the Fed's ability to assess the U.S. job market and made it harder to determine when to adjust rates, Yellen said. "Uncertainty is the key word," said Ian Shepherdson, chief economist at Pantheon Economics. "Yellen is not about to leap from the fence at the next [Fed] meeting." Yellen said that for now, a broad assessment of the job market suggests that the economy still needs Fed support in the form of ultra-low rates and that inflation has yet to become a concern. "The assessment of labor market slack is rarely simple and has been especially challenging recently," Yellen said at the conference, which the Federal Reserve Bank of Kansas City sponsors each year at a lodge beside the majestic Grand Tetons. Yellen invoked language the Fed has used that record-low short-term rates will likely remain appropriate for a "considerable time" after the Fed stops buying bonds to keep long-term rates down. The bond buying is set to end this fall. Yellen stressed that the Fed's rate decisions will be dictated by the economy's performance. Repeating language from an appearance before Congress in July, Yellen said that if the economy improved faster than expected or if inflation heated up, rates could rise sooner. But she also said that if the economy under-performed, the Fed could delay its first rate hike. "Monetary policy is not on a preset course," she said. In a separate speech, Mario Draghi, head of the European Central Bank, said the ECB was prepared to do more to boost the shaky recovery in the 18 nations that use the euro. But he said governments must coordinate efforts to reduce persistently high unemployment. The ECB has cut rates and offered cheap loans to banks and is considering asset purchases to pump more money into Europe's economy. Draghi told the Jackson Hole conference that "we stand ready to adjust our policy stance further" if needed. But he offered no guidance on when such help might come. In her keynote address, Yellen suggested that pay gains for U.S. workers, which have been sluggish since the recession ended five years ago, could rise faster without necessarily igniting inflation. John Silvia, chief economist at Wells Fargo, said Yellen's remarks confirmed his view that the Fed's first rate increase will occur next June. "Yellen still wants more time to evaluate the data," he said. Silvia also said the speech hints that the Fed is "willing to take a little more inflation to achieve their labor market goals." If inflation were to top the Fed's target of 2 percent, "I don't think they're going to panic." This year's conference drew a pocket of demonstrators who shadowed Yellen and the other participants in the lobby of the lodge as they entered and left the invitation-only gathering. They sported green T-shirts and carried placards with the question, "What recovery?" Related to this year's conference theme of "Re-evaluating Labor Market Dynamics," Yellen's speech addressed the difficulty the Fed faces in trying to determine the relative health of the job market given the damage caused by the 2007-2009 recession. Paul Dales, senior U.S. economist at Capital Economics, wrote in a research note that "despite the faster-than-expected decline in the unemployment rate, Yellen does not appear to have changed her view that there is still 'significant' slack in the labor market." Yellen's comments came two days after release of the minutes of the Fed's July 29-30 meeting. The minutes showed that officials engaged in an intensifying debate over whether to raise rates sooner than expected if the economy keeps strengthening. Some officials, the minutes said, thought the Fed would need "to call for a relatively prompt move" to begin raising short-term rates from record lows, where it has kept them since the financial crisis struck in 2008. Otherwise, they felt the Fed risked overshooting its targets for unemployment and inflation. In the end, the Fed made no changes at the July meeting. It approved, 9-1, maintaining its current stance on rates. But the minutes pointed to a distinct division among officials over the timing of an increase. That debate continued at Jackson Hole, with Fed officials expressing clashing views during a series of TV interviews. Charles Plosser, president of the Fed's Philadelphia regional bank, said he was uncomfortable with the Fed's policy statement that it expects to keep its key short-term rate unchanged for a "considerable time" after its bond purchases end. Plosser cast the lone dissenting vote at the July meeting. Dennis Lockhart, president of the Atlanta Fed, said in a CNBC interview Friday that he was "holding to the mid-2015" time period for the first rate hike but said this view could change if the economic data strengthens. Nicholas Colas, chief market strategist at the investment firm ConvergEx, said Yellen's speech did nothing to change his expectation that the Fed will begin to raise rates in the second quarter of 2015. "Janet Yellen is maintaining as much space for herself for policy flexibility as she possibly can," Colas said. "She's underlining how complex this is."
